In full transfer of power to Matignon, the Attorney General near the Court of Cassation announced that a judicial investigation was going to be opened against Prime Minister Edouard Philippe, the current Minister of Health, Olivier Véran and the one who has it preceded by Agnes Buzyn.

Since the start of the epidemic in France, 90 complaints have been received in the context of the Covid-19 crisis against the Prime Minister or one of the members of his government. Some denounce facts of "endangering the life of others", "manslaughter" or "failure to assist a person in danger".

34 inadmissible complaints

“After examining 53 complaints out of the 90 filed to date, the Complaints Commission of the Court of Justice of the Republic today issued two decisions. A first decision by which it finds 34 complaints inadmissible, either because of its incompetence or because of the complainants' lack of interest in taking action, ”said the prosecutor's press release.

The Complaints Commission of the Court of Justice of the Republic is the only body capable of trying ministers for acts committed in the exercise of their missions. Composed of ten senior magistrates, it plays a role in filtering complaints, mostly from individuals, associations or unions. Certain complaints not designating a minister or targeting persons not belonging to the government were therefore not admissible.

On 19 other complaints, the requests commission of the Court of Justice of the Republic transmitted nine to the Attorney General at the Court of Cassation on the sole count of "abstention from combating a disaster, an offense provided for and punished by article 223 -7 of the penal code1 ". It directly targets Edouard Philippe, Agnès Buzyn and Olivier Véran.

The ten other complaints, targeting Nicole Belloubet, Jean-Yves Le Drian, Minister of Foreign Affairs, Florence Parly, Bruno Le Maire, Christophe Castaner, Muriel Pénicaud, Laurent Nunez and Sibeth Ndiaye were dismissed.

"It is now up to the Attorney General - bound by the terms of this decision - to open judicial information against Mr. Edouard Philippe, Ms. Agnès Buzyn and Mr. Olivier Véran, for the above qualification", specifies the press release.
