The Provincial Court of Alicante has acquitted the former leader of the Socialist Youth of Elche, Alejandro Díaz , from the crime of sexual abuse of a two-year-old girl from her closest family environment of which she had been accused and for which the Prosecutor's Office requested five years in prison. The ruling, to which EL MUNDO has had access, argues that this decision is given, he explains, "in the absence of sufficient evidence of charge that could undermine the presumption of innocence that protects all accused."

In this way, Díaz, represented by the lawyer José Luis Sánchez Calvo , signs his first judicial 'victory' since another trial is still pending for the storage, consumption and distribution of a package of images of adults raping newborn babies by the who faces nine years in prison. This is the matrix process, which brought to light the alleged sexual abuse of the girl from which he has now been exonerated.

The images and comments that the young man allegedly made to an interlocutor - "I imagine them screaming and crying while raping them. The agents were able to bring the issue of abuse to the little girl to court based, precisely, on a conversation intervened on Díaz's computer as a result of her arrest for the consumption and distribution of the babies' videos.

In this dialogue to which the court has not validated, he recognized his interlocutor - and also boasted - of having consummated the abuse of the girl and told him that she was still with him in the room. However, the Alicante Court does not give credibility to this witness and does give evidence to the mother of the little girl, the family of Alejandro Díaz, who has always denied that his daughter was the victim of abuse.

"The Chamber, applying the rules of sound criticism, has considered plausible (without incurring contradictions) both the responses of Alejandro's mother and, above all, those of his sister." Thus, the court has not estimated one of the psychological reports to which the child was submitted, as well as its reliability.

"The girl's credibility is undetermined. But, above all, that the minor only expresses some extreme about her uncle when, at the end of the examination and with evident signs of exhaustion, direct questions are asked about him." In addition, it is supported by the criteria of another psychologist who also explored her. "He claims that the minor has shown no signs of assault, or sexual abuse by anyone around her."

Alejandro Díaz was arrested in July 2017 and the judge sent him to prison. A month later, his lawyer got him released on bail of € 20,000.
