In the Central African Republic, the modification of the Constitution is rejected

Deputies had proposed an amendment to the Constitution. According to him, in the event of postponement of the elections due to force majeure, as is the case with the coronavirus crisis, the President of the Republic would remain in place until the taking up of office by a new head of the state. After having obtained the support of the government, this text had been transmitted to the Constitutional Court which delivered a negative opinion.

It was the President of the Constitutional Court Danielle Darlan who presented the institution's decision this Friday morning. It considered that the procedure for obtaining 2/3 of the votes necessary for deputies to present this reform was not in accordance with the Constitution.

The Constitutional Court above all considered that this amendment would necessarily entail a modification of the duration of the mandate of the President of the Republic . The people have clearly expressed their desire to institute a constitutional lock on the mandate of the President of the Republic,  " said Danielle Darlan. This lock can not be reviewed even by its representatives deputies "  except to betray this will,  " she said.

Strong remarks made by the president who also reread the terms of the swearing in of the current head of state.

In conclusion, Danielle Darlan, confirming the legal vacuum in the event of inability to respect the legal deadlines, recommended, if this case were to arise, the organization of a national concertation. In order to reach a consensual solution that can frame the postponement of the elections and the slippage of the electoral calendar  ," she said.
