The Superior Court of Justice of Catalonia (TSJC) has authorized the demonstrations that Vox has called this weekend in the capitals of the four Catalan provinces. In this way, despite the current health emergency situation, the protest can be carried out throughout Spain against the Government, calling for the resignation of Pedro Sánchez and Pablo Iglesias, although by car to guarantee security measures.

Vox appealed against the Interior Ministry's decision to ban these protests, and the court has held that protests can be held as long as precautions are taken to prevent the spread of coronavirus, such as riding in a private vehicle for half an hour and wearing a mask. The TSJC held four hearings, one per petition in each provincial capital, and the Prosecutor's Office also favored allowing the protests, considering that the state of alarm does not impede the right to demonstrate as long as it is done while preserving the necessary sanitary guarantees.

After detailing that the Prosecutor's Office has always been rigorous with the right to demonstrate, he added that it did not make sense to do it in other Spanish capitals and not in Girona, Tarragona and Lleida, which are in phase 1 of the de-escalation, such as in Barcelona, ​​which It is still in phase 0, the same as in Madrid.

However, the State Attorney's Office opposed the protests, considering that there is a risk of contagion from coronavirus, given that, in addition to a private vehicle, protesters can also attend the event by motorcycle or bicycle. "The right to life, integrity and health is above the right of assembly," stressed the State lawyer before recalling that in Catalonia there are twice as many positive Covid-19 cases as in Spain to claim that keep the ban.

"A car rally cannot prevail over the right to life," concluded the State Advocacy. For his part, the legal representative of Vox indicated that the demonstration is not suspended due to the state of alarm and that, if prohibited in Catalonia, it will incur "a comparative grievance with respect to other provinces that are in the same phase as the Catalan ones" .

Independence protest

The Interior Ministry endorsed a demonstration by the October 3 independence platform called for Saturday in the Plaza Sant Jaume in Barcelona, ​​"on condition that" sanitary security measures are taken. The organizers criticize "a state of emergency disguised as a state of alarm" for which they will demonstrate for one hour, with a maximum attendance of 50 people, and will maintain the safety distance between them. The organizers consider that it is the first demonstration not prohibited in Catalonia since the state of alarm decree and note that, after a first rejection, the security measures were modified to receive authorization.

No freedom to infect

On these demonstrations, the Minister Spokesperson, María Jesús Montero, pointed out to the citizens who protest against the management that the Government is making of the coronavirus pandemic that if they can do it it is because the state of alarm only restricts the right of assembly or free movement , but has insisted that "freedom cannot be confused with freedom of contagion".

Montero remarked that the simple convening of these demonstrations are the "main example" that the only rights affected by the state of alarm are that of assembly and that of movement. That is why he considers it "contradictory" to manifest himself to the cry of "freedom" when precisely what is done with that slogan is to exercise it. "But you cannot confuse freedom with freedom for contagion," he said.
