Dubai Appeals Prosecution appealed the preliminary ruling in the case of the victim of medical error, Rawda Al-Muaini, on the instructions of the Attorney General, Counsel Issam Issa Al-Humaidan, requesting an increase in the punishment against the accused.

Attorney Rawda al-Muaini, the attorney for the medical mistake, attributed the attorney, Issa bin Haider, to the request to increase the punishment to three main reasons, namely, achieving justice for an innocent young woman who forbade the practice of her life naturally, unjustified neglect, and sending a clear message to those working in this field to ensure that these serious mistakes are not repeated.

The court of first instance ruled after several deliberations and reviewed the reports of the technical and medical committees, with a one-year imprisonment followed by deportation of the three accused in the case of the young citizen, Rawda Al-Muaini, who are the surgeon, the anesthesiologist, and the anesthesia technician. It is the ruling that the Dubai Public Prosecution decided to appeal against, requesting a severe punishment against the defendants, and the Appeals Court is scheduled to decide when the case will start.

For his part, lawyer Issa bin Haider, who initiated the defense’s adoption in this case, expressed his appreciation and full support for the Public Prosecution’s decision to challenge the preliminary ruling in the case of medical error caused by the neglect suffered by the citizen Rawda Al-Mu’ini, which led to her entering a complete and continuous coma Until now.

Bin Haider told «Emirates Today» that he demanded during the pleadings that the punishment be increased for the accused for several reasons, foremost among which is the deprivation of an innocent young woman from practicing her life naturally, as a result of the severe medical error she was subjected to, and the unacceptable or justified negligence of some doctors who are supposed to practice A humanitarian profession requires providing the utmost care and attention to their patients, pointing out that the third reason lies in the fact that: “tougher punishment is a message for the rest of the workers in this field so that such grave mistakes are not repeated in our safe society in which all the means and capabilities were provided in order to be a safe and healthy society Hygienically ».

Investigations by the Public Prosecution revealed that the events of the incident began last April, when the victim felt difficulty breathing through her nose, so she sought the first suspect (ENT) who examined her, and diagnosed her condition as suffering from a deviation in her nasal septum, and she needed surgical and cosmetic intervention Earlier, an appointment was made for her to perform the surgery on April 23, in a one-day surgery center that was not prepared to perform this type of surgery, in the presence of the second accused (anesthesiologist), and the third (assisted anesthesia technician).

The Public Prosecution ended its investigations after hearing the witnesses and the authors of the attached medical reports, and interrogated the defendants after reviewing the various medical reports, and concluded in its investigations that the responsibility of the surgeon, anesthesiologist, anesthesia technician, and the one-day surgeries center in which the surgery was performed, was proven, prompting the Attorney General To refer the accused to the criminal trial.

The report of the Supreme Committee for Medical Responsibility concluded that the surgeon and anesthesiologist committed a grave error against the patient, Rawda Al-Muaini, and they bear full responsibility for the health damages and severe complications that occurred to her. The report also held the medical center part of the responsibility.

The Dubai Health Authority announced that it would take immediate action to stop the professional licensing of the surgeon involved in the case, to continue to suspend the professional licensing of the anesthesiologist, and to continue to close the operating rooms in the center where the operation was performed.
