The former president of the Board of Andalusia and former Andalusian Minister of Economy and Finance José Antonio Griñán has announced that he will appeal to the Supreme Court the "Judgment not adjusted to law" ruling of the Seville Hearing on the ERE that sentenced him to 6 years of jail and 10 disqualification for embezzlement and prevarication, in which, according to what he says, the judges made several "mistakes . THE WORLD has had access this Thursday to the announcement of Griñán's appeal, which pivots on the following reasons: two violations of the law, a violation of constitutional rights and a breach of form by the "lack of clarity in the story of proven facts" and the "manifest contradiction" of the ERE ruling, the biggest cause of open corruption in the country.

The Court of Seville condemned on November 16 to 19 former senior officials of the Board, among which are, in addition to Griñán, the former president of the Andalusian Government Manuel Chaves and former advisors Gaspar Zarrías, Magdalena Álvarez, Antonio Fernández, José Antonio Viera, Francisco Vallejo and Carmen Martínez Aguayo . They were convicted of designing an illegal system to dispose of and grant discretion hundreds of millions of euros, skipping all controls and all rules, with the aim of stifling labor disputes and maintaining social peace in Andalusia during the PSOE governments. 679 million were distributed over a decade.

The announcement of Griñán's appeal against this judgment warns that the judges of the Hearing made several "errors" in the "assessment of the evidence" based on documents that act in the case, such as the budgets of the Board of several years or General Intervention reports in which there is no appreciation of "impairment of public funds" .

In Griñán's opinion, the judges of the Court who have condemned him by the ERE have violated his constitutional rights to the presumption of innocence, the right to defense, effective judicial protection and fair trial.

The appeal for "violation of the law" is based on the alleged "improper" application of two articles of the Criminal Code that refer to the crimes of embezzlement and prevarication for which Griñán was convicted in the Judgment of the Hearing.

The five-page announcement of the appeal is signed by Griñán's new lawyer, José María Calero , who replaces the former defender of former Board President José María Mohedano .
