The Attorney General of the Emirate of Dubai, Counselor Issam Issa Al Humaidan, has ordered the defendants in the Rawda Al-Muaini case, a victim of serious medical error, to be referred to the criminal trial, due to their serious medical error, which left them with sustainable disabilities, namely the surgeon, anesthesiologist, and anesthesia technician, And the one-day surgery center where the surgery was performed.

Investigations by the Public Prosecution revealed that the events of the incident began last April, when the victim felt difficulty breathing through her nose, so she turned to the first suspect (ENT) who examined her, and diagnosed her condition as suffering from a deviation in her nasal septum, and needed surgical and cosmetic intervention In the nose, and set her date for the surgery on April 23, in one of the one-day surgery centers not prepared for this type of surgery, in the presence of the second accused (anesthesiologist), and the third (anesthesia technician for him).

Investigations showed that the surgical operation was marred by serious medical errors, according to the description of the medical reports accompanying the investigations, which resulted in the victim suffering permanent disabilities.

The Public Prosecution ended its investigations after hearing the witnesses and the authors of the attached medical reports, and interrogated the defendants after reviewing the various medical reports, and concluded in its investigations to prove the responsibility of the surgeon, anesthesiologist, anesthesia technician, and the one-day surgery center where the surgery was performed, which led to the Attorney General To refer the accused to the criminal trial, and an urgent trial session is being identified.

The Public Prosecutor issued his decision No. 23 of 2016 to form a team to investigate and dispose of medical errors cases, consisting of a number of public defenders and chief prosecutors, headed by the first attorney general and chief prosecutor Hamad Juma Al-Khilafi, and specialized in investigating the case of Rawda Al-Muaini Cases of medical errors, counselor Younis Hussein Al-Balushi.

Immediately after the papers were received, the Public Prosecution initiated the preliminary report of the Dubai Health Authority to initiate investigations over several months, during which it sent supplementary medical reports and responses from the Health Authority until September 2019, and the Public Prosecution waited for the report of the Supreme Committee for Medical Responsibility to be received after consideration of the grievances formed according to Decree Federal Law No. 4 of 2016 regarding the legal responsibility of the accused, to complete its investigations.

The report of the Supreme Committee for Medical Responsibility concluded that the surgeon and anesthesiologist committed a grave error against the patient, Rawda Al-Muaini, and they bear full responsibility for the health damages and serious complications that occurred to her. The report also held the medical center part of the responsibility.

The Dubai Health Authority announced that it would take immediate action to stop the professional licensing of the surgeon involved in the case, to continue to suspend the professional licensing of the anesthesiologist, and to continue to close operating rooms in the center where the operation was performed.

The “Commission” noted the efforts of the Supreme Committee for Medical Responsibility, which sent the final report regarding the patient, Rawda Al-Muaini, to the “Commission”, then to the Public Prosecution, confirming its commitment to take all deterrent ways and measures that preserve the rights and safety of patients.

Investigations have shown that the operation was seriously marred, according to the description of the medical reports.

Dubai Health has suspended the professional licensing of the surgeon and anesthesiologist, and closed the operation rooms of the medical center.
