The former counselor, currently Professor of Economics at the University of St. Andrews , faces a trial in Spain for sedition, based on the sentence received by her nine fellow independents who decided not to escape and faced responsibility for 1-O . The judicial instruction placed her at the center of the 1-O preparations, since as a former Minister of Education she had an important participation in the opening of the schools as centers of an illegal vote .

The Scottish Prosecutor, who acts in the process on behalf of Spain, considers that the equivalent in the United Kingdom of the crime of which Ponsatí is accused is "treason", contemplated in Scottish Law.
