It was late on a Saturday night in September that the two met for the first time. The 28-year-old was in the company of another man and they had the woman accompany her home at an after-party.

They served her alcohol and changed numbers. She thought she should go home, but fell asleep on the couch. When she wakes up and realizes that the 28-year-old is abusing her, she screams and finally manages to push him away, she tells the court.

The 28-year-old's version of it all is that the woman asked him to have sex with her and that she took off her clothes herself.

Witness

The third man testified in the trial that he was awakened by the woman screaming "I never want to see you again" and that the 28-year-old answers "sorry, sorry, I'm drunk".

The woman then leaves the apartment and calls 112. When the ambulance staff finds her, she sits on the roadside and cries.

Assess None

The district court assesses the woman's version of what has happened as "long, detailed, free from inaccuracies, contradictions, exaggerations and difficult to explain moments" and that it is in good agreement with the witness's observations.

The 28-year-old's story, on the other hand, is poor in detail and can partly be disproved on issues that do not directly concern the rape. In addition, his credibility declines by initially denying that they were even met - even though his DNA traces suggest the opposite.

The man is a citizen of Serbia and in addition to prison for two years he is also sentenced to deportation.
