The Superior Prosecutor's Office of Catalua has filed with the Superior Court of Justice of Catalonia (TSJC) a complaint against the Minister of Interior Miquel Buch and a sergeant of the Mossos d'Esquadra for the crimes of prevarication and embezzlement of public flows. The court must now study whether or not to admit the complaint to process, the previous step to decide whether to investigate.

Based on a complaint from Citizens, the Prosecutor's Office began its investigation last March that now ended in a complaint after finding that there are indications of crime. Specifically they point out that in July of last year Bucho appointed as "security systems advisor" of a Sergeant of the Mossos with a remuneration of almost 36,000 euros per year. The Public Ministry considers that this contracting "constitutes an act of arbitrariness" since "this designation responded only to the purpose of procuring, from the Government of the Generalitat and with charges to the public funds of a permanent escort service to the declared rebel defendant" in the cause of the Supreme Court Carles Puigdemont, escaped to Belgium.

The complaint also indicates that the Sergeant of the Mossos helped Puigdemont in his flight from his home in Sant Julià de Ramis (Girona), like other "public officials" of the Mossos, to France "where he took a plane that led him to Belgium". From that situation, the Mossos Internal Affairs Division opened an investigation against the sergeant for a serious offense.

The Prosecutor's Office notes that between October 2017 and July 2018 the police "did not carry out a single act of active service in their own activity as a regional police officer, having instead detected by the investigating police force, the study of news appeared in media as well as the public content of social networks, numerous exits abroad of the same in order to provide custody and security for the, and then, processed Puigdemont rebel. "

The Internal Affairs file ended with a sanction of forced transfer of destination but the sergeant was not incorporated when appointing an Interior Advisor although he lacks "the slightest knowledge or training for the exercise of the entrusted function". However, the complaint highlights that after his appointment, the defendant has continued as an escort for Puigdemont, as he himself expressed through social networks, even offering advice to those who approached Waterloo. The sergeant ceased his activity last March and his activity had a cost to the public coffers of about 53,000 euros.
