The Court of Appeal of Toulouse reversed on Thursday the closing of a Muslim school out of contract of the city and relaxed its director who had been condemned in first instance in 2016 for "teaching non conforming", one learned from the school lawyer.

The director of the school initially sentenced. In the judgment obtained by AFP, the Court of Appeal of Toulouse invalidates the judgment of the TGI of Toulouse who ordered the closure of the establishment and sentenced the director of the school Al-Badr, the imam Abdelfatthah Rahhaoui, a four-month suspended prison sentence and a ban on running an educational institution. The secondary court also relaxed the Al-Badr association which ran the school. This cultural association had been fined 5,000 euros and a "permanent ban on exercising".

A judicial turnaround after a QPC. The National Education criticized the school run since 2013 by the imam Rahhaoui, known for its conservatism, not to leave "sufficient room for basic education in French compared to Koranic teachings in Arabic," said Mr. Samim Bolaky. A judicial reversal that comes after a priority question of constitutionality (QPC) filed by the lawyer of the Muslim school, Mr. Bolaky, during a first appeal hearing on December 14, 2017.

A new structure ... she also summoned to justice. The Parisian lawyer said the school had reopened with the constitution of a new cultural association, "school group Al-Badr". This new structure is again summoned to justice in Toulouse late January. According to Mr. Bolaky, this final convocation, which is based on the conviction of 2016 for which his clients have obtained the release, could therefore have no follow-up.
