“The prosecutor believes that such a preventive measure as arrest is disproportionate to the acts committed and is excessively harsh, and insists on house arrest. The appeal must be considered within three days, ”the department’s press service told RT.
One of the lawyers of the head physician, Yevgeny Serykh, told RT that he had appealed against the preventive measure. He abstained from any substantive comments on the case. The second lawyer, Inna Yuferova, refused to answer RT questions.
Tragedy in the maternity hospital
According to the investigation, on November 5, a woman was admitted to the maternity hospital №4, who was at 23-24 weeks pregnant, who gave birth to a boy weighing 700 grams the next day. The condition of the infant was maintained with the aid of an artificial lung ventilation apparatus and the administration of a medicinal product, shown to support life activity - Kurosurf.
According to investigators, Belaya instructed the medical staff to take all possible measures to ensure that the child did not survive, ostensibly due to the high cost of the medicine and the deterioration in the statistics of infant mortality.
On the same day, the child died in the maternity hospital, after which, according to the investigators, the suspect ordered to enter into the history of childbirth deliberately false information that the baby died in the womb and he was born dead.

In court, the defense stated that the investigation did not have a single argument that Belaya gave instructions to the hospital staff not to use drugs or to take anything to take the life of the infant.
“If she is suspected of something, it is only in official forgery,” the lawyers said.

At a court hearing on the choice of a measure of restraint to the suspect, the investigator explained that after the child was born, Belaya instructed the midwife not to use the drug "Kurosurf", since it is too expensive. The investigation insisted on the arrest of the suspect so that she would not influence the investigation and the witnesses.

Elena Belaya herself stated that she did not agree with the request of the investigators.
Lawyers for the suspect argued that the media "are aggravating public resonance and psychosis about the case, and the Investigative Committee has become a hostage of this resonance, which he himself created." According to the defenders of the woman, the court was not provided with solid evidence, the suspicion raised was not confirmed by anything, and the arguments of the investigation were contrived.
The prosecutor agreed with the position of the lawyers, who stated that the arguments that Belaya could put pressure on the investigation are far-fetched.
In court, the 27-year-old mother of the deceased baby also spoke out: “We begged her to save the child, but she did not give him a chance.”
The judge ruled that the crime accused of Elena Belaya belongs to the category of grave, the maximum punishment for it is 10 years imprisonment. From the materials submitted to the court it follows that Belaya tried to hide the traces of the crime, she has a passport, which means she can leave Russia. The court arrested the woman until January 14, 2019.
Doctors against arrest
The medical chamber of the Kaliningrad region insists on the mitigation of the preventive measure for Elena Bela.
According to the executive director of the organization, Nikolai Ivanayev, imprisonment is an excessively cruel preventive measure for a doctor who has always faithfully fulfilled his duties.
According to Ivanayev, the medical chamber is preparing to appeal to the Investigation Committee, the prosecutor's office and the National Medical Chamber with a request to soften the preventive measure of Belaya.
“Most of the doctors of Kaliningrad signed the appeal. This is a lawlessness of some kind, all measures by doctors were taken. In each team there are adverse moments. Everyone can not please. As one of the midwives of the maternity hospital told me, Belaya is quite a tough manager, but in our time this is necessary, ”Ivanayev said.
In addition, the man added that the appeal in defense of the arrested was signed by about 150 obstetricians and gynecologists of the city, including colleagues from Belaya and 1,500 other doctors of other specializations.

Ivanaev noted that the problem had already been discussed with the president of the Research Institute of Emergency Pediatric Surgery and Traumatology Leonid Roshal, who also spoke in support of Elena Belaya.

She came to Russia from Uzbekistan about a year ago and lived in Kaliningrad without a residence permit. I didn’t apply to the antenatal clinic; there was no insurance policy. According to him, it can be concluded that the maternity hospital has not quite a healthy atmosphere, “internal disassembly is not excluded.”

According to him, the drug "Kurosurf", which allegedly regretted for a baby, was in the hospital in sufficient quantities. In addition, the child needed medication was introduced. Repeated administration of the drug should have been made in 17 hours, but six hours before that, the child had died.
Roshal stressed that open media accusations that the child died due to the fact that he was not given “Kurosurf” are “a lie and excite people against medical workers.”

The representative of the regional administration, Natalya Gatsko, also reminded that Belay was charged with abuse of office under paragraph “c” of Part 3 of Art. 286 and Part 1 of Art. 286 of the Criminal Code of the Russian Federation due to the fact that it gave instructions to its subordinates to falsify the history of childbirth.
