  In 2014, Zhang Tianbei's biological mother Li Ting (pseudonym) was detained by the Shuishiying Police Station in Lushunkou District, Dalian City for drug trafficking. At that time, the two-year-old child was left unattended. Li Ting proposed to be raised by Zhang Guizhen, the mother of her boyfriend at the time.

Zhang Guizhen named this unrelated child "Tianbei", which means "a treasure raised by God" and gave her own surname.

As the child left by the former girlfriend of Zhang Guizhen's son, Tianbei's identity is embarrassing, and there are constant quarrels at home. Because of the mystery of his biological father and the uncooperation of his biological mother, Tianbei could not go to the hukou and became a "black household".   In September 2014, Su Ying, deputy director of the Shuishiying Police Station in Lushunkou District, received clues that Li Ting and Zhang Guizhen’s son Zhang Youming were suspected of taking drugs and arrested them.

At that time, the two were living together.

  According to the China Judgment Document Network, on September 11, 2014, Zhang Youming was administratively detained for five days by the Lushunkou Branch of the Dalian Public Security Bureau for drug use. He was also detained twice for drug use since then.

Li Ting’s verdict did not show publicly, Su Ying remembered that “she was sentenced to two years for drug trafficking”.

  Su Ying recalled that after being detained, Li Ting proposed that she had a child over 2 years old who had been born out of wedlock. He had been living in Zhang Guizhen’s house for several months. His biological father did not know his existence and was unable to cooperate in raising him. Continue to help take care of the children.

  A deputy director surnamed Wang of the Shuishiying Police Station recalled that in October 2019, during the police's home visit, she met with Zhang Guolin. “At the time, he asked my child’s mother if it was impossible to settle down. I answered the question from the settlement policy, requiring the father or mother to bring his birth certificate and household registration book to settle down, and he never came to me again."

  A reporter from the Beijing News consulted the "Opinions on Solving the Issue of Registered Household Registration for Persons without Hukou" issued by the State Council in 2016. The opinions show that people without hukou who do not comply with the family planning policy, and those who give birth outside of the policy or who give birth out of wedlock, are themselves Or the guardian can apply for permanent residence registration based on the "Medical Birth Certificate" and one parent's residence booklet, marriage certificate or illegitimate childbirth instructions, in accordance with the voluntary policy of setting up with the father and mother.

  In the spring of 2018, it was time for the 6-year-old Tianbei to go to elementary school, and her household registration suddenly became an urgent matter.

The Sigou Elementary School said, "If you don't have a hukou, you can't go to school."

At that time, Luo Jiajin, the director of social security in Sigou Village, also helped to negotiate with the school, but to no avail, "No way, you can't go to school without a permanent residence."

  Regarding the argument that children without a hukou cannot go to school, lawyer Wang Yingyu said that children without hukou also have the right to receive compulsory education.

The "Compulsory Education Law" stipulates that all school-age children with the nationality of the People's Republic of China...have the right to receive compulsory education on an equal basis in accordance with the law and perform their obligation to receive compulsory education.

  "However, because you need to apply for school registration in elementary school, you cannot apply for school registration without a household registration. Therefore, if you do not have a household registration, you can ask the public security agency to issue a certificate that the household registration is in process." Wang Yingyu said.

  Whether they have ever contacted a public security agency, both sides argued differently, but it is a fact that Tianbei never had a permanent residence.

This also became the deadlock of his inability to go to school.

There are school buses passing by in the village every day. Neighbors remember that as soon as six o'clock in the morning, Tianbei will run to the roadside on time and watch the school bus pass by. He said, "I want to send the children to school"; at four o'clock in the afternoon, he He stayed by the road early again, waiting for the school bus to return.

  Zhang Guizhen only has the level of third-grade education in elementary school. She usually doesn't have pen and paper at home. She can only teach Tianbei a few simple words on the glass. He hasn't learned to write his name until today.

  The lack of hukou also affected Tianbei's adoption.

One month after Tianbei was sent back by his grandmother, Zhang Guolinto's friend contacted a family in downtown Dalian. It was a 50-year-old couple with good family conditions and no children.

This is the best place for Tianbei that Zhang Guolin can think of.

  However, according to Article 5 of the Adoption Law of the People's Republic of China, only guardians of orphans, social welfare institutions, and biological parents who have special difficulties and are unable to raise their children can be adopted as adopters.

On January 19, Chang Yingzhi, director of the Propaganda Department of the Lushun Branch of the Dalian Public Security Bureau, told the Beijing News reporter that on December 25, 2020, the Lushun Branch received Zhang Guolin’s request for the child to settle down for the first time, and then they found Zhang Youming and Zhang Youming. Zhang Guolin understood the situation and obtained Zhang Tianbei's birth medical certificate from the Second People's Hospital of Lushunkou District.
