The administrative court of Montpellier (Hérault) suspended, this Wednesday morning, the opening orders for businesses considered non-essential, signed by several mayors of Occitanie, in particular the mayors of Perpignan (Pyrénées-Orientales), Louis Aliot ( RN), and from Béziers, Robert Ménard (various right).

These elected officials had authorized the shops to reopen their iron curtains, despite the containment measures put in place by the State to fight against Covid-19.

"The judge of summary proceedings of the administrative court of Montpellier suspends (...) the execution of the orders of the mayors of Béziers, Perpignan, Carcassonne, Claira and Pia", indicates this Wednesday, on its Internet site, the administrative court of Montpellier.

“If the mayor can (…) take measures intended to contribute to the proper application (…) of the measures decided by the competent authorities of the State, he can only take such additional measures under his general police power. for compelling reasons linked to local circumstances (…) and on condition of not compromising the consistency and effectiveness of those taken by the competent State authorities ”, continues the summary judge in his decision.

Tuesday, before the administrative court of Montpellier, Robert Ménard, the mayor of Béziers, and Louis Aliot, his counterpart from Perpignan, had themselves defended their orders.
