A guardian in his 30s in Fukuoka Prefecture was charged with sexually assaulting a 14-year-old girl who lived with him, and was acquitted in the first instance, but was revoked in the second instance. The decision was made to dismiss the defendant's appeal.

In the future, the hearing will be redone at the Fukuoka District Court.

A man in his thirties who lives in Fukuoka Prefecture has been acquitted of being accused of sexually assaulting a 14-year-old adopted girl who lived with him as a guardian.

In July last year, the Fukuoka District Court of the first instance acquitted the victim, saying, "The testimony of the victim cannot be said to be credible."

On the other hand, the Fukuoka High Court of the second trial said in March, "It is more likely that it is rational to think that the victim's testimony is supported by other objective evidence and the testimony of a doctor. The trial lacked consideration for underage victims, and the judgment was suspected of being misleading. ”He canceled the innocence and ordered the trial to be redone in the first trial.

In response, the defendant had appealed, but Judge Hayashi Michiharu of the Supreme Court's Third Small Court decided to dismiss the appeal by the 12th, and the trial will be redone at the Fukuoka District Court in the future.

In the trials over sexual violence, a series of acquittals were filed in courts nationwide last year, so there is a growing movement to request revisions to the criminal law, and the Ministry of Justice is considering it.
