The complaint has been sent.

A staff member of the Administrative Litigation Service Center of Chengde Intermediate Court told the Beijing News reporter that a notice of rejection of the appeal had been issued to the parties. After the first appeal was rejected, the complainant could submit an appeal to the higher court, which is in line with the procedure. . In addition, the complaint is generally delivered to the case filing court of the Administrative Litigation Service Center, which is responsible for receiving and accepting it.

Chengde Intermediate Court rejects appeal

According to the Beijing News, in 2016, Li Shuxian and her third daughter Guan Guixiang were sentenced to jail for provoking trouble. In 2018, Li Shuxian repeatedly submitted applications for out-of-batch medical treatment to the Hebei Provincial Prison Administration because of his 80s and two lumbar fractures in prison, and he was unable to take care of himself. In 2019, Li Shuxian was released on parole and returned home. Guan Guixiang served his sentence in jail until January 27, 2020.

On July 3, 2019, Li Shuxian, accompanied by his family and aid lawyers Yang Xuelin and Wang Fei, went to the Chengde Intermediate Court to submit a complaint, hoping that the court could reassign Li Shuxian and his third daughter Guan Guixiang.

On the morning of October 25, 2019, Li Shuxian's family received a “Notice of Rejection of Appeal” issued by Chengde Intermediate People's Court. A Beijing News reporter confirmed from the Chengde Intermediate People's Court that the court considered that the appeal submitted by Li Shuxian and Guan Guixiang did not meet the conditions for retrial, and it had been rejected and the original ruling was maintained.

The notice showed that after reviewing by Chengde Intermediate Court, Li Shuxian and Guan Guixiang were venting their emotions and had nothing to do. They repeatedly dropped petition materials at non-letter and visit places and disrupted the order of public places, which constituted the crime of provocation. According to the existing video materials, witness testimony and other evidence, Li Shuxian and his daughter Guan Guixiang have made frequent visits to Beijing, dropped petition materials, and were repeatedly punished by the public security authorities for administrative punishment. It is a joint crime. The original conviction and sentencing were not inappropriate, and the trial procedure was legal.

In the end, the Chengde Intermediate People's Court held that Li Shuxian's grounds of appeal in this case could not be established, and the appeal did not meet the retrial conditions stipulated in Article 253 of the Criminal Procedure Law of the People's Republic of China, and the original judgment should be maintained.

Continue to appeal to Hebei High Court

In response to the dismissal of the complaint by the Chengde Intermediate People's Court, Li Shuxian's younger daughter Guan Guixia told the Beijing News that they could not accept it. On January 27, Guan Guixiang had served his sentence and was released from prison. After returning home, he had been with his mother.

On the 31st, the logistics information provided by Guan Guixia to the reporter of the Beijing News showed that the "criminal complaint" had been sent to the High Court of Hebei Province via China Post.
