The deputy LREM Yaël Braun-Pivet tabled this Wednesday a bill to strengthen the monitoring and surveillance of "terrorists who come out of prison". According to the Interior Ministry, around 150 detainees convicted of "terrorism" are expected to be released from prison between 2020 and 2022.

According to Yaël Braun-Pivet, the rule of law "does not guarantee" a follow-up adapted to the "potential dangerousness" of people who leave prison after convictions for "terrorism". The deputy thus pleads for "new constraints" that could be ordered by the court of the enforcement of sentences, "upon requisition of the public prosecutor".

Measures renewable up to 20 years

The elected representative of Yvelines and the co-signer of the text Raphaël Gauvain (LREM) propose "security measures", of "immediate" application, unlike penalties or "existing measures", some of which were voted in 2016 would not be " of retroactive application ”for previous convictions.

These new security measures could be "ordered for a period of one year, renewable within a limit of ten years in correctional matters and 20 years in criminal matters", it is stated in the bill. Among the potential constraints: "the obligation to establish residence in a specific place" or "to obtain an authorization before any change of job or residence as well as for any trip abroad".

Three years in prison for non-compliance

The former detainee could also be subject to "prohibitions on entering into contact and appearing in certain places", "placement under mobile electronic surveillance (electronic bracelet)" or obligations to "report periodically to the services of police or gendarmerie units, up to three times a week ”. If he fails to comply with these obligations, he would face up to three years' imprisonment and a fine of 45,000 euros.

The Braun-Pivet proposal aims to supplement the administrative control and surveillance measures (Micas) of the 2017 anti-terrorism law (Silt), a text decried by the defenders of public freedoms. Its text could be examined in committee at the end of April.
