The procedure called into question

However, you were previously considered to be at fault, since you first had to pay the post-parking package before going to the Pay Parking Litigation Commission (CCSP), located in Limoges.

The legislator's idea was thus to limit dilatory disputes.

Even the Defender of Rights recommended that the government modify these excessive restrictions on access to judges in January 2020. But it was ultimately the Constitutional Council that had the last word after being seized by the Council of State of a priority question of constitutionality.

In a decision of September 9, 2020, the Wise Men considered that requiring a prior payment to be able to contest a post-parking pass was a substantial infringement of the right to exercise an effective judicial remedy and therefore of the Constitution.

Therefore, this provision is simply deleted.

Once the “post-parking package” has been received, you have one month to file a mandatory prior administrative appeal (Rapo).

The payment advice must specify who to contact and how.

You must attach the copy of the disputed FPS, that of the vehicle registration card, your argument and the necessary supporting documents (vehicle transfer document, complaint for theft, inclusion mobility card, parking ticket, etc.).

You have one month after the notification of the rejection of the Rapo to enter the Paid Parking Litigation Commission (CCSP) online or by mail.

On the other hand, if you wish to contest an increased post-parking fee, you can directly enter this instance in the month following the notice, without going through the prior administrative appeal.
