“The rejection of the Nord Stream 2 application shows the discriminatory effect of the amended EU Gas Directive,” the statement said.

Nord Stream 2 recalled that it had filed a lawsuit to repeal the amendments to the directive to the EU General Court, as well as that it was conducting arbitration proceedings under the Energy Charter Treaty.

The company notes that Nord Stream 2 is a project that has received “all necessary permits” and is being implemented in accordance with applicable national and international laws.

“We look forward to receiving an official decision and then evaluate it and consider further actions to protect our rights, including appealing this decision in German courts,” the statement said.

They recalled that the appeal is possible within a month after the decision.

The company emphasized that the situation around the Gas Directive will not affect the completion of the Nord Stream 2 construction.

Earlier, the German regulator rejected the application of Nord Stream 2 AG, the operator of the Nord Stream 2 project, to release the pipeline project from the requirements of the EU Gas Directive.
