An ordinance of the law Food on the raising of the threshold of resale at a loss and the framing of the promotions on certain food products, which was to be examined last Wednesday in the Council of Ministers, will be finally on December 12, announced this Friday the The Minister of Agriculture.

An ordinance of the Food law providing for an increase of the resale at a loss (SRP) threshold and framing promotions on certain food products, will finally be examined by the Council of Ministers "on December 12" announced Friday the Ministry of Agriculture.

This announcement comes at three days of a protest movement of the peasant world at the call of the majority union FNSEA, in particular to request the publication of this order supposed to allow, with others expected by mid-2019, a improvement of farmers' income.

The text implements the compromises from the States General of Food between producers, the agro-food industry that processes raw products, and distributors.

The exam rejected in extremis with yellow vests

The order is intended to better distribute the added value between the actors of the sector, recalls the release.

Its review originally scheduled for Wednesday in the Council of Ministers, was postponed in extremis because of the movement of yellow vests, cascading the announcement by the FNSEA of a week of claims-based events whose messages are very similar to those of Yellow vests (purchasing power, anti-tax).

The Estates General of Food had been convened after the election of President Emmanuel Macron, especially to try to respond to the unease of farmers who can no longer earn a living from their work.

Prohibition of promotions such as "a product purchased, a free"

According to the order, as of February 1, 2019, food distributors will be required to resell products at least 10% more than they bought them, the statement said. It also prohibits promotions such as "A product purchased, a free" in the food sector, widely used in the context of the supermarket price war.

From January 1st, 2019, in value, it will thus be necessary to at least buy the equivalent of two products to be able to profit from a free one. In addition, distributors may only apply this type of promotion on 25% of the annual volume purchased for the product, for all contracts negotiated with their suppliers since December 1, 2018.

Two other Food Post-Law Orders are expected by mid-2019, one on the prohibition of "improperly low prices" , and the other on the requirement for a separation of counseling activities from those of sale of phytosanitary products, in agricultural trade and cooperatives.
